Welcome to Retail Success, LLC.  We help retail businesses enhance their buyers’ experiences through our payment, software, marketing and point of sale solutions.  This Privacy Policy explains how we collect, use and share personal information.

What Personal Information do we collect?

“Personal Information” means any information that personally identifies an individual or can be used in combination with other data to identify an individual.  The legal name and definition of Personal Information differs from jurisdiction to jurisdiction. Retail Success will not use or share Personal Information other than as described in this Privacy Policy.

Personal Information may include, among other things, an individual’s name, e-mail address, mailing address, phone number, credit card information, and history of communications, transactions and use of our Websites.  Personal Information on our various solutions may also be controlled or maintained by the retail businesses we directly serve (“our Customers”), and you should check their Privacy Policies for information on how those Customers may collect and use Personal Information collected directly from you.

Personal Information does not include aggregated or anonymized information from which no individual natural person can be identified (“Aggregated Data”). We use Aggregated Data to analyze consumer behavior and trends, to improve and enhance our Services and to create and develop new diagnostic tools and features with our Services. Retail Success shall own all rights, title and interest in its Aggregated Data.

How do we use Personal Information?

For Personal Information we collect directly from individuals, we may use it to improve our Websites and Services; provide customer service and technical support; process transactions; communicate with you by e-mail, postal mail, telephone, text message, and/or mobile devices about our Services that may be of interest; perform research and analysis to gauge the use of the Websites and Services; enforce this Privacy Policy and other Retail Success policies or agreements; or for any legally permissible purpose.  We may use or combine such Personal Information with other information we obtain through third-parties.

For Personal Information collected or shared with us by our Customers, or otherwise maintained on our Services, we will use it to enhance, improve or facilitate the Customer’s interactions and business transactions with you. 

For all Personal Information, you acknowledge and agree that we may use and disclose it for inspection by law enforcement officials (including in the case of potential criminal activity); to respond to cease and desist letters, arbitration proceedings, legal actions and suits, criminal and civil subpoenas, any court orders; to enforce or apply the terms of this Privacy Policy or any other agreement between us; and to protect us, our Customers, users and others’ rights, property, or safety, whether during or after the use of our Services.

With whom do we share Personal Information?

We may share Personal Information with our affiliates, licensees, subsidiaries and successors; our partners, vendors or others who help us operate or assess individuals’ interest in the Services; or as necessary to third parties who provide information technology services such as website hosting, computer systems maintenance, or data security and privacy for our Services, provided they have contractually agreed to adhere to this Privacy Policy.  We may also share Personal Information to comply with our legal obligations, enforce this Privacy Policy or any other Retail Success agreements, or otherwise to protect the rights, property or safety of our Customers, users and business partners.  We may share the Personal Information collected or shared with us by our Customers, or otherwise maintained on our Services, with those Customers or with third parties as directed by our Customers.  We may share Aggregated Information and other non-Personal Information with third parties for any lawful purposes.

How do we protect your information?

We implement a variety of security measures, including select encryption and secure transmission protocols, to maintain and secure Personal Information and to protect against its loss, misuse or alteration.  We cannot guarantee the absolute security of the Personal Information we seek to protect. Therefore, although we take steps to secure your information, we cannot and do not promise or warrant that your information will always remain secure.

How do we use cookies or other information collection technology?

For visitors to our Websites, we may use various technologies, including “cookies” to automatically gather certain information pursuant to your use of the Websites, from your electronic device about your activities using the Websites. 3)     the right, with some exceptions, to have your personal information deleted from Retail Success’ possession or control; and

4)     the right to receive equal service and pricing from Retail Success even if you exercise any of your privacy rights.

Do Not Track Signals

Our Websites do not respond to Do Not Track signals in browsers because the standard and adoption of such signals is not uniform or sufficiently prevalent.

Information of Children

In accordance with COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

We cannot guarantee or verify the contents of third-party websites. You click on such third-party links at your own risk, and you agree that we are not liable for harm or damages caused by your visiting them. This Privacy Policy does not cover the use or handling of your information by any third-party site (including those of our Customers).  The privacy policy of the third-party will govern. We encourage you to visit the websites of those third-parties and fully read and understand their privacy policies.  Some of these entities will have different privacy terms than we do and their servers may be located outside the United States.

If you do not wish to receive promotional emails or other marketing communications from us, please let us know by using the opt-out response device that can be found at the bottom of every email we deliver or by contacting us as provided below. At places on our Websites where you give us your personal information, you may opt out of receiving those communications. Although you can opt not to receive promotional messages, we reserve the right to send you informational email messages about any user account you establish on our Websites or with respect to our Services, or notices regarding the Websites or Services, as permitted.

This Privacy Policy may be updated from time to time.  We reserve the right to modify the Policy at any time without notice, so please review the Privacy Policy frequently.  When changes are made to this Privacy Policy, we will revise the “Last Updated” date at the bottom of this Privacy Policy.  Your continued use of our Websites or Services after we have posted any policy changes indicates your agreement to the changes unless you notify us otherwise.
